We start this episode with Locke preparing breakfast in his Dharma house. He takes the tray down into the basement to a locked room where Ben is being kept. He goes in to deliver the breakfast and on the tray is a book. Ben makes a remark about it being a book from his own shelf and that he already read it, and Locke tells him to read it again because he might "catch something you missed the second time around." Locke asks Ben about Miles and if he really knows what's going on, and Ben pretends he doesn't know who he is talking about. He then tells Locke that he must be desperate to come to him for help. He can't find Jacob or his house and he's more lost than he's ever been before. Locke takes Ben's breakfast from him, but keeps his cool until he leaves the room, and then he lashes out in the hallway.

Kate, Claire and Aaron are sitting on their front porch in the Dharmahood when Sawyer walks over. He comments that he'll get Hurley to move out, insinuating that he expects her to move in, and she tells him she won't move in with him and that she wants him to go away.

FlashForward: Katherine Anne Austen is at her trial, the charges are read against her, and she pleads not guilty. The prosecutor recommeds she does not get bail on account of her financial status and claims she's a flight risk. Kate's attorney says she couldn't possibly go anywhere because she has one of the most recognizeable faces in the country, but the judge rules that she be remanded into custody for the duration of the trial.

Back on the Island, Sun and Jin are looking at a map. Sun points to Albuquerque (interestingly enough, he's pointing almost RIGHT at my in-law's house...) and he asks her in English "Albuquerque?" She says "too hot". He says, "New York?" and she says "too many people". In Korean, he says, "More than Seoul?" and she says she wants to raise her baby at home, in Korea, and he counters with "OUR baby". Jack and Charlotte return to the island. Sun and Jack talk about what happened, he tells her Kate wanted to stay with Locke.

Back in the Dharmahood, Kate goes to see Locke and tells him she wants to see Miles. He says no, and that this isn't a democracy, she says it must be a dictatorship, he says if that were the case, he'd have shot her. He won't even tell her where Miles is being kept. Kate goes outside and sees Hurley carrying a tray of food obviously meant for Miles. She asks if it's for him, he says yes, and then she says Locke sent her to bring him the food. She asks if he's still in the rec room, and he says, "No, I moved him to the boat house" and then realizes she's lying. "Did you just Scooby-Do me?" he asks her, and she apologizes.

She goes to the boat house and sees Miles is tied up inside. She goes in and starts asking him if he knows who she is. Miles says he'll tell her what she wants to know if he does something for her. He tells her he wants to speak with someone, and we assume it's Ben.

FlashForward: Kate and her lawyer are speaking privately. He tells her they need to make a deal and she refuses. He says the only other option is to have "him" come in, so they can talk about her character now as opposed to talking about what she did or did not do before. Kate is adamant that she does not want "him" to be put on the stand. She does not want "him" to be brought into all of this. "I won't use my son" she finally tells him. DUN DUN DUH! She has a son.

Back on the Beach: Sun asks Jack about Sayid and he's telling her that they left on the helicopter the night before.

Again in the Dharmahood, Kate and Claire are doing laundry, just chatting when Claire asks Kate to pick up a fussy Aaron. She says she doesn't because she isn't good with kids and she doesn't want to upset him more. Claire picks up Aaron and says she never thought she'd be a good mom. She then tells Kate she should "try it sometime" and Kate looks all serious.

FlashForward: Back in the courtroom during Kate's trial... her lawyer leans to her and says "Please don't fire me, I had to do something" then stands and calls Dr. Jack Shepard to the stand. Kate looks obviously bothered. Jack is sworn in as a character witness since he didn't know Kate at the time of the alleged crimes. He testifies that they crashed on Oceanic flight 815 on September 22, 2004. He then proceeds to lie and say the marshall didn't survive the crash, that in fact, only eight of them had. He testifies that the plane crashed into the water, Kate helped to save his life along with the lives of the other survivors. Kate stands and asks him to stop. The judge starts to reprimand her and her lawyer says he's done with Jack anyway. The prosecution then gets to cross-examine Jack and asks him only if he loves Kate. He replies "No. Not anymore."

In the Dharmahood, Sawyer is reading and Hurley is putting on Xanadu. Kate comes in, they go to speak privately in the kitchen. He offers her wine, which they both drink, and then tells her that if she doesn't want him, she needs to at least tell him what she wants to use him for. She tells him she wants to bust out Ben.

Sawyer knocks on Locke's door and invites him to play backgammon. As they are setting up the game they are talking, Locke asks if Sawyer believes in him, has confidence in where he's leading them. Sawyer says he doesn't want to leave the island, Locke asks what the others are saying, and Sawyer answers, "Baa" and says they are all just sheep. Sawyer then tells Locke that he wants Locke's word that he won't harm Kate. Locke gives it and then Sawyer tells him that Kate came to see him about busting out Ben. Locke and Sawyer immediately go to the boat house to find Miles is gone. We then see that Kate has Miles, with his arms tied together, and they are breaking into Locke's house. They go downstairs, she shoots the lock off of Ben's door, and shoves Miles inside. She tells him he has one minute.
Miles asks Ben if he knows who he is and Ben nods. He asks if he knows who he works for, and again, Ben nods. He then tells Ben that for $3.2 million, he'll return to the boat and tell them that he found Ben dead. Ben says Charlotte saw him alive, and Miles says he will take care of her. Ben says ok, and Miles says he's giving him two days to have the money to him, in cash, and he'll tell the other people on the boat that Ben is dead. Ben says he's in a bit of a tough spot right now (referring to being locked in his own basement by Locke) and Miles says ok, you have one week to pay up.

Kate pulls Miles out of Ben's room and then throws him up against the wall in the hallway. She asks if he knows who she is. He is able to tell her her full name and is able to list most of the charges against her. He tells her to stay on the island. On the way out, Locke and Sawyer catch them on the stairs. Locke tells Kate to leave.

Kate is back in the house she shares with Claire and Aaron. She is sitting on the couch listening to the radio when Claire comes to check on her. Kate says she couldn't sleep, and Locke comes to the house. He asks to speak to Kate privately, and Claire leaves them alone. Locke wants to know what Miles and Ben said to eachother, and Kate tells him everything. Locke then tells her that she is no longer welcome in the Dharmahood.

FlashForward: Kate's mother comes to see her. She is the prosecution's star witness. She is in a wheelchair and on oxygen. Kate and her mother are both very icy to eachother. Mom asks Kate if Jack was telling the truth. Kate doesn't answer, but tells her that she doesn't want her there. Mom says the doctors have given her 6 months to live for the past four years, and that she doesn't want to testify against her. Kate says "then don't" and Mom says she wants to see her grandson. Kate refuses and says she doesn't want her anywhere near him.

In the Dharmahood, Kate goes to Sawyer's room. Once again he's reading, but this time in just boxers. :rawr: She tells him that Locke told her she needs to go, and he says Locke can't do that, she can stay with him in his house, then there's a rumble from the next room and he corrects himself with "Me & Montezuma's house". He tells her "I'll keep you safe" and they start undressing and kissing.

Back on the beach: Charlotte is testing the physicist's memory (Sorry, I can't remember his name) with three cards. She has them facedown and he is able to accurately recall two of the three cards. She says it's an improvement and he says, "It was three cards" and sounds discouraged or doubtful. Jack and Juliet approach and start grilling Charlotte about not being able to get an answer on the boat. She says she can't know anything about that since she's on the island. They want to know if there is another number, and she tells them there is an emergency number. Juliet hands her the phone and tells her to call it, and Jack tells her to do it on speakerphone. She calls the number and there's an answer. The person on the other end of the phone asks why she called this line, and Charlotte says it's because there was no answer on the other one, but they wanted to know what was going on with the Losties on the boat. The receiver says there isn't anyone that has come back to the boat. Charlotte tells her the helicopter left the night before and the receiver says they thought the helicopter was still on the island.

Back at the boathouse, Locke has Miles tied up in a standing position with his arms over his head. Locke tells Miles he wants to know who the people on the boat are and who they were hired by, why they were hired and what they are there to do or find. Locke pulls the pin out of a grenade and sticks it in Miles' mouth. He tells him he realized there can't be rules if there are no punishments for breaking them, and that Miles needs to answer his questions, but until he's ready, he needs to keep his mouth shut. Literally and figuratively, as we see if Miles opens his mouth, the grenade will go off.

Kate and Sawyer wake up in bed together, she starts kissing him, and they start to go at it again, but she pulls away and says no. He reveals that they didn't do it the night before, and starts to call her on her BS. He says he understands that last night she was "sad" and so they didn't do it, and what's the problem now? Is she scared about possibly being pregnant? She says no, she isn't pregnant, yes she's sure. He is relieved she isn't, and she asks if it would be the worst thing in the world if she had been. He says yes, it would have been, what would they have done with a baby. She gets mad and gets up and starts getting dressed, and he says she's just using that as an excuse to go back to the beach, but he's not worried because in another week she'll get mad at Jack for something and she'll come back to him. She slaps him and leaves.

FlashForward: Back in the courtroom, the disturbed looking prosecutor is talking to an aide of some sort when the judge starts asking for her to proceed. She stands and says she needs to approach the bench at which time both lawyers walk to speak to the judge. The prosecutor says the star witness is unable to testify due to medical problems and the judge calls a recess until after lunch, at which point he says the prosecution will need to continue.

We then see Kate and her lawyer and the prosecutor speaking in private about a deal. At first the prosecutor offers 4 years and probation, but Kate shakes her head. Her lawyer counters and says "No jail time." Prosecutor offers time served, 10 years probation, and Kate can't leave California. Her lawyer starts to counter with something else and Kate interrupts. "I'll take it. I'll sign whatever you want, I just want this to be over"

Kate walks out the back door of the courthouse into a parking garage where there is a waiting taxi. She loosens her hair and I got the feeling she was ready to run for it, but then Jack approaches. He was waiting for her. He tries to ask her out, she asks if he'd like to come over, he says he can't, but how about coffee another time. She says to him "I understand why you don't want to see him, but until you do, there's no coffee just you and me."

She goes home to a nice house and walks inside. There's a nanny (maybe?) who greets her and says she just put him down for a nap. Kate walks upstairs into a nice boys' room. A young blonde boy, maybe 3 years old, is laying in bed. She goes and sits on the edge of his bed and plays with his hair as he starts to stir. He sits up and hugs her and says, "Hi Mommy" and she holds him and says, "Hi Aaron". DUN DUN DUH!!!!
